General terms and conditions as a travel agent


The following terms and conditions govern the legally different types of mediation Regarding travel services and package tours, the rights and obligations of the customer and the intermediary depend on the type of travel service provided. A distinction must then be made between...


  1. the mediation In the case of a package tour, hereinafter referred to as "travel agency", the agent in this context is referred to as "travel agent"; the regulations regarding this can be found in section A of these terms and conditions.
  2. the arrangement of linked travel services; the regulations for this can be found in section B of these terms and conditions.
  3. the brokering of a single travel service; the regulations for this can be found in section C of these terms and conditions.


Section D contains the terms and conditions, which apply equally to all types of services.



Section A

Regulations for the Travel agency of package tours according to § 651v BGB


The provisions of this Section A concerning the intermediation of package travel contracts apply when Big 5 Africa Tours - Ulrike Steingruber provides the standard information form for package travel. The form identifies the tour operator being brokered as the responsible company for providing the package tour.


1. Conclusion of contract, legal regulations


1.1. Upon acceptance of the customer's booking request by Big 5 Africa Tours - Ulrike Steingruber, a contract for the booking of a package tour is concluded between the customer and Big 5 Africa Tours - Ulrike Steingruber as the travel agent. The request and its acceptance do not require any specific form. If the request is submitted electronically (email, internet, online booking form, fax, messenger services), Big 5 Africa Tours - Ulrike Steingruber will confirm receipt of the request electronically. This confirmation of receipt does not yet constitute acceptance of the booking request.


1.2. The mutual rights and obligations of the customer and Big 5 Africa Tours - Ulrike Steingruber as travel agent arise, unless mandatory legal provisions dictate otherwise, from the agreements made contractually in each individual case, these terms and conditions and the statutory provisions, in particular Sections 651a et seq. of the German Civil Code (BGB) in conjunction with Articles 250 et seq. of the Introductory Act to the German Civil Code (EGBGB) and Sections 675, 631 et seq. of the German Civil Code (BGB) concerning paid agency services.


1.3. The rights and obligations of the customer vis-à-vis the tour operator through which the booking was arranged are governed exclusively by the agreements made with the tour operator, in particular – insofar as effectively agreed – its terms and conditions of travel or business. Unless otherwise agreed or specifically indicated, transport services are subject to the conditions of carriage and fare regulations issued by the competent transport authority on a statutory basis or pursuant to international conventions.


2. Payments, customer declarations


2.1. Travel agents and tour operators may only demand or accept payments towards the travel price before the end of the package tour if the tour operator has a valid customer funds protection agreement and the customer has been provided with the certificate of insurance, clearly, comprehensibly and prominently displaying the name and contact details of the customer funds protection provider.


2.2. Big 5 Africa Tours - Ulrike Steingruber is generally not authorized by the tour operator to accept complaints or other declarations from the customer/traveler regarding the provision of the package tour. However, Big 5 Africa Tours - Ulrike Steingruber will inform the tour operator of such declarations from the traveler without delay. To avoid delays, Big 5 Africa Tours - Ulrike Steingruber recommends that, despite immediate forwarding, such declarations be made directly to the tour guide or the tour operator's contact point.



3. General contractual obligations of the travel agent, information, advice


3.1. Based on these terms and conditions, the customer will receive the best possible advice. Upon request, Big 5 Africa Tours - Ulrike Steingruber will then submit the booking request to the tour operator. The service obligation includes, after confirmation by the tour operator, the provision of the documents for the arranged travel service(s). This does not apply if it has been agreed that the tour operator will send the documents directly to the customer.


3.2. When providing other information and advice that the travel agent is not obligated to disclose under Section 651v Paragraph 1 of the German Civil Code (BGB) in conjunction with Article 250 Sections 1 to 3 of the Introductory Act to the German Civil Code (EGBGB), Big 5 Africa Tours - Ulrike Steingruber is liable, within the framework of the law and contractual agreements, for the correct selection of the information source and its accurate transmission to the customer. An information contract with a primary contractual obligation to provide information only comes into existence upon a corresponding express agreement. Big 5 Africa Tours - Ulrike Steingruber is not liable for the accuracy of information provided, pursuant to Section 675 Paragraph 2 of the German Civil Code (BGB), unless a separate information contract has been concluded.


3.3. Unless expressly agreed otherwise, Big 5 Africa Tours - Ulrike Steingruber is not obligated to identify and/or offer the most affordable provider of the requested travel service. This does not affect the travel agent's contractual obligations under any "best price guarantees" they may have issued.


3.4. Unless expressly agreed otherwise, Big 5 Africa Tours - Ulrike Steingruber assumes no guarantee within the meaning of § 276 para. 1 sentence 1 of the German Civil Code (BGB) with regard to information on prices, services, booking conditions and other circumstances of the travel service, nor any procurement guarantee within the meaning of this provision with regard to information on the availability of the services to be arranged by the travel agent.


3.5. Big 5 Africa Tours - Ulrike Steingruber accepts special requests only for forwarding to the tour operator being brokered. Unless expressly agreed otherwise, Big 5 Africa Tours - Ulrike Steingruber is not responsible for fulfilling such special requests. These requests are also not a condition or basis of the brokerage agreement or of the booking confirmation to be forwarded by the travel agent to the tour operator. The customer is advised that, as a rule, special requests only become part of the tour operator's contractual obligations upon express confirmation by the tour operator.



4. Obligations of the travel agent in the event of customer complaints against the package tour operators brokered by the agent.


The customer may also notify their travel agent, through whom they booked the package tour, of any defects or other issues concerning the performance of the travel services by the tour operator. These notifications will be forwarded. However, the customer is expressly advised that any defect notification must be addressed directly to the tour operator. The travel agent has no obligation to advise the customer on the nature, scope, or amount of any claims they may have against the tour operators they have booked with.



Section B

Regulations at the mediation of linked travel services pursuant to Section 651w of the German Civil Code (BGB).


The provisions of this Part B concerning the arrangement of linked travel arrangements apply when Big 5 Africa Tours - Ulrike Steingruber provides the form on the arrangement of linked travel arrangements. This form informs the customer that booking an additional travel service with Big 5 Africa Tours - Ulrike Steingruber does not constitute booking a package tour, but may result in the arrangement of a linked travel arrangement.

This confirmation of receipt does not yet constitute acceptance of the booking request.


1.2. The mutual rights and obligations of the customer and Big 5 Africa Tours - Ulrike Steingruber arise, unless mandatory legal provisions dictate otherwise, from the agreements made contractually in each individual case, these terms and conditions and the statutory provisions, in particular Sections 651a et seq. of the German Civil Code (BGB) in conjunction with Articles 250 et seq. of the Introductory Act to the German Civil Code (EGBGB) and Sections 675, 631 et seq. of the German Civil Code (BGB) concerning paid business services.


1.3. The rights and obligations of the customer vis-à-vis the contractual partner of the brokered linked travel services are governed exclusively by the agreements concluded with that partner, in particular – insofar as effectively agreed – its terms and conditions of travel or business. Unless otherwise agreed or specifically indicated, the conditions of carriage and fare regulations issued by the competent transport authority on a statutory basis or pursuant to international conventions apply to transport services.



2. Payments


2.1 The intermediary of linked travel arrangements may only accept payments from the traveler for remuneration for travel services if he has ensured that these will be reimbursed to the traveler insofar as travel services are to be provided by the intermediary himself or payment claims of intermediary service providers are still to be settled and in the event of the insolvency of the intermediary of linked travel arrangements.

 

  • Travel services are cancelled or
  • The traveler complies with payment requests from unsatisfied service providers with regard to travel services rendered.


2.2 The intermediary of linked travel arrangements provides this security by concluding insolvency insurance in accordance with Section 651w Paragraph 3 of the German Civil Code (BGB), clearly, comprehensibly and prominently stating the name and contact details of the customer funds insurer, and by issuing a corresponding security certificate for all payments made by the customer to the intermediary of linked travel arrangements, unless the customer pays the service provider of the linked travel arrangement directly.



3. General contractual obligations of the intermediary, information, advice


3.1. Based on these terms and conditions, the customer will receive the best possible advice. Upon request, Big 5 Africa Tours - Ulrike Steingruber will then submit the booking request to the service providers. The service obligation includes, after confirmation by the service provider, the handover of the documents for the arranged travel service(s). This does not apply if it has been agreed that the service provider will send the documents directly to the customer.


3.2. When providing information and advice, Big 5 Africa Tours - Ulrike Steingruber is liable, within the framework of the law and contractual agreements, for the correct selection of the information source and its accurate transmission to the customer. An information contract with a primary contractual obligation to provide information only comes into existence upon a corresponding express agreement. The intermediary is not liable for the accuracy of information provided, pursuant to Section 675 Paragraph 2 of the German Civil Code (BGB), unless a separate information contract has been concluded.



3.3. Unless expressly agreed otherwise, the intermediary is not obligated to identify and/or offer the most affordable provider of the requested travel service. This does not affect the intermediary's contractual obligations under any "best price guarantees" issued by them.


3.4. Unless expressly agreed otherwise, Big 5 Africa Tours - Ulrike Steingruber assumes no guarantee within the meaning of Section 276 Paragraph 1 Sentence 1 of the German Civil Code (BGB) regarding information on prices, services, booking conditions, and other circumstances of the travel service, nor does it provide a procurement guarantee within the meaning of this provision regarding information on the availability of services to be arranged by the intermediary.


3.5. Big 5 Africa Tours - Ulrike Steingruber accepts special requests only for forwarding to the service provider being brokered. Unless expressly agreed otherwise, Big 5 Africa Tours - Ulrike Steingruber is not responsible for fulfilling such special requests. These requests are also not a condition or basis of the brokerage agreement or of the booking confirmation to be forwarded by the broker to the service provider. The customer is advised that special requests generally only become part of the service provider's contractual obligations upon express confirmation by the service provider.



4. Obligations of the intermediary in the event of customer complaints against the service providers brokered by the intermediary


4.1. Claims must be asserted against the service providers brokered through the agency within specific time limits, which may arise from law or contractual agreements. As a rule, these time limits are not met by asserting claims against Big 5 Africa Tours - Ulrike Steingruber. This also applies if the customer wishes to assert claims against both the agency and the service provider with regard to the same travel service.


4.2. In the event of complaints or other claims against the service providers brokered, the broker's obligation is limited to providing the necessary information and documents known to him, in particular the names and addresses of the service providers brokered.


4.3. If the intermediary undertakes to forward the customer's timely claims letters, even without being obligated to do so, he is liable for the timely receipt by the recipient only if the delay was caused intentionally or through gross negligence by him.


4.4. Regarding any claims the customer may have against the service providers brokered, the broker has no obligation to advise on the type, scope, amount, prerequisites for claims, applicable deadlines, or other legal provisions.


Section C


Regulations for the brokering of individual travel services or multiple travel services that do not constitute linked travel services within the meaning of Section 651w of the German Civil Code (BGB).

The provisions of this Part C concerning the brokering of individual travel services apply if the brokered travel service is neither part of a package tour nor part of linked travel arrangements. In this case, providing the customer with information via a standard form is not legally required.

These requests are also not a condition or basis of the brokerage agreement or of the booking confirmation to be forwarded by the broker to the service provider. The customer is advised that, as a rule, special requests only become part of the service provider's contractual obligations upon express confirmation by the service provider.


3. Obligations of the intermediary in the event of customer complaints against the service providers brokered by the intermediary.


3.1. Claims must be asserted against the service providers brokered through the agency within specific time limits, which may arise from law or contractual agreements. This also applies if the customer wishes to assert claims against both the agency and the service provider with regard to the same travel service.

Section D

  1. Regulations apply equally to all types of services


1. Booking and conclusion of contract


1.1. Bookings and the resulting contracts are legally binding in the respective countries, such as Uganda, Rwanda, Tanzania, Kenya, and Madagascar. The applicable laws and contractual regulations apply.


1.2. Participation of minors in the trips is only possible if accompanied by their legal guardians.



2. Obligations of the travel agent and the traveler regarding entry requirements and visas


2.1. If Big 5 Africa Tours - Ulrike Steingruber undertakes, for a fee or free of charge, the registration of the customer within electronic systems for obtaining entry authorization as a prerequisite for entry into or transit through certain countries, the following applies: Unless expressly agreed otherwise, the undertaking of this service does not obligate the travel agent to provide further information or inquiries regarding entry or transit formalities or transit stays during the trip, and in particular, not to obtain visas. The customer is advised that the electronic entry authorization does not replace the final entry permit issued by the border authorities of the respective country.


2.2. Big 5 Africa Tours - Ulrike Steingruber is not obligated to obtain visas or other documents required for travel unless specifically agreed upon. If such an order is accepted, Big 5 Africa Tours - Ulrike Steingruber may, without an explicit agreement, demand reimbursement of expenses incurred that it could reasonably deem necessary under the circumstances. Big 5 Africa Tours - Ulrike Steingruber may also demand payment for its services if such payment has been agreed upon or if, under the circumstances, the services were only to be provided against payment.

 

2.3. Big 5 Africa Tours - Ulrike Steingruber is not liable for the issuance of visas and other documents, nor for their timely receipt. This does not apply if the circumstances leading to the non-issuance or delayed receipt were caused or contributed to by the travel agent's negligence.


2.4. The customer is obligated to comply with the customs regulations of both the country being visited and their home country. The customer is responsible for informing themselves about the applicable regulations.



3. Reimbursement of expenses, fees, collection, payments


3.1. Big 5 Africa Tours - Ulrike Steingruber is entitled to demand payments in accordance with the terms and conditions of service and payment of the service providers it brokers, provided these terms are validly agreed between the service provider and the customer and contain legally valid payment provisions. Big 5 Africa Tours - Ulrike Steingruber may assert payment claims against the customer, insofar as this corresponds to the agreements between the broker and the service provider, as the latter's authorized collection agent, but also in its own right based on the customer's statutory obligation to advance payment as the principal pursuant to Section 669 of the German Civil Code (BGB).


3.2. The above provisions apply accordingly to cancellation fees (compensation for withdrawal) and other legally or contractually justified claims of the mediated service provider.


3.3. The customer may not, by way of retention or set-off, assert claims against the intermediary's own payment claims on the grounds that the customer has claims against the service provider brokered through the intermediary, in particular due to defective performance of the brokered contract. This does not apply if the emergence of such claims was caused or contributed to by a culpable breach of contractual obligations by the intermediary, or if the intermediary is liable to the customer for the asserted counterclaims for other reasons.


3.4. A deposit of 30% of the tour price is due upon conclusion of the contract. Further payments are due on agreed dates. The remaining tour price is due no later than 30 days before departure, provided the voucher has been issued and the tour is no longer cancelled. It can be cancelled.
Permits for gorilla and chimp tracking are payable immediately and are non-refundable.


3.5. For bookings made less than 4 weeks before the start of the trip, the entire trip price is due immediately upon conclusion of the contract.


3.6. Payments can be made in cash or by bank transfer. For payments via PayPal, an additional fee of 2.9% of the travel price applies; for payments via PayPal using a QR code, the fee is 0.9% of the travel price.


3.7. If the customer defaults on payment of the travel price, either partially or in full, the service providers are entitled, after issuing a reminder and setting a deadline, to withdraw from the contract and claim damages.



4. Position and duties of the travel agent in connection with the brokering of air transport services


4.1. Big 5 Africa Tours - Ulrike Steingruber is obligated to inform the passenger of the identity of the operating airline at the time of booking. If the operating airline is not yet known at the time of booking, the agent will provide the passenger with the information available from the company they are representing regarding the airline that is likely to operate the flight. In the event of a change of airline, the customer will be informed immediately.


4.2. The contractual relationship between the customer and the airline is governed by the respective legal provisions.



5. Documents relating to the services provided


5.1. Both the customer and Big 5 Africa Tours - Ulrike Steingruber are obligated to check the accuracy and completeness of all contractual and other documents of the service provider concerning the travel services provided to the customer by Big 5 Africa Tours - Ulrike Steingruber, in particular booking confirmations, flight tickets, hotel vouchers, visas, insurance certificates and other documents relating to the travel services provided, especially for conformity with the booking and the brokerage agreement.


5.2. If documents relating to the arranged travel services are not sent directly to the customer by the service provider, they will be provided by the travel agent via postal or electronic means.


6. Customer's duty to cooperate with the travel agent


6.1. The customer must immediately notify Big 5 Africa Tours - Ulrike Steingruber of any errors or deficiencies in their services that are apparent to them. This includes, in particular, incorrect or incomplete personal customer data, other information, details and documents concerning the travel services provided, as well as the incomplete execution of services (e.g., bookings or reservations not made).


6.2. If the customer does not submit a notification in accordance with section 6.1, the following applies:

a) If the customer fails to notify the authorities in accordance with section 6.1 through no fault of his own, his claims are not forfeited.

b) The customer's claims against Big 5 Africa Tours - Ulrike Steingruber are excluded to the extent that the customer proves that, had the defect been properly reported, the customer would not have incurred any damage or would not have incurred damage to the extent claimed. This applies in particular if Big 5 Africa Tours - Ulrike Steingruber proves that immediate notification by the customer would have given Big 5 Africa Tours - Ulrike Steingruber the opportunity to remedy the defect or mitigate damage, e.g., through rebooking, additional booking, or cancellation.

c) The customer's claims in the event of a failure to notify in accordance with section 6.1 are not excluded in the following cases:

  • in the event of damages resulting from injury to life, body or health caused by an intentional or negligent breach of duty by the travel agent or a legal representative or agent of the travel agent.
  • in the case of claims for compensation for other damages that are based on an intentional or grossly negligent breach of duty by the travel agent or a legal representative or vicarious agent of the travel agent.
  • in the event of a breach of a material obligation, the fulfillment of which is essential for the proper execution of the brokerage contract or the breach of which jeopardizes the achievement of the purpose of the contract.


Liability for booking errors according to § 651x BGB remains unaffected.


6.3. The customer's contractual and/or legal obligation to report defects to the mediated service provider remains unaffected.


6.4. The customer is requested, in his own interest, to inform Big 5 Africa Tours - Ulrike Steingruber of any special needs or restrictions with regard to the requested package tour.



7. Important information about insurance


7.1. Big 5 Africa Tours - Ulrike Steingruber points out the possibility of taking out travel cancellation insurance when booking in order to minimize the risk of costs in the event of cancellations by the customer.


7.2. The customer is further advised that travel cancellation insurance typically does not cover losses incurred due to a trip being interrupted after its commencement, even if the interruption is not the customer's fault. Trip interruption insurance must generally be purchased separately.


7.3. Big 5 Africa Tours - Ulrike Steingruber also recommends ensuring adequate international health insurance coverage when traveling abroad.


7.4. When arranging travel insurance, the customer is advised that the terms and conditions of the arranged travel insurance policies may contain special contractual conditions and/or obligations of the customer, in particular exclusions of liability (e.g., in the case of pre-existing conditions), the obligation to cancel immediately in the case of trip cancellation insurance, deadlines for reporting claims, and deductibles. The arbitrator is not liable insofar as they have not provided false information regarding the terms and conditions of the insurance and the arranged travel insurer has the right to refuse coverage to the customer based on validly agreed-upon terms and conditions of the insurance policy.



8. Liability of the travel agent


8.1. Unless Big 5 Africa Tours - Ulrike Steingruber has assumed a corresponding contractual obligation by express agreement with the customer, it is not liable for the conclusion of contracts with the service providers to be brokered.


8.2. Big 5 Africa Tours - Ulrike Steingruber is not liable for defects and damages incurred by the customer in connection with the arranged travel services. This does not apply in the case of an express agreement or assurance to this effect by the travel agent, in particular if this deviates significantly from the service description of the service provider.


8.3. Any liability of the travel agent under § 651x BGB or for the culpable breach of travel agent duties remains unaffected by the above provisions.



9. Consumer Dispute Resolution

Under current law, we are obliged to inform consumers of the existence of the European Online Dispute Resolution platform, which can be used to resolve disputes without having to go to court. The European Commission is responsible for setting up the platform. You can find the European Online Dispute Resolution platform here:

Big 5 Africa Tours - Ulrike Steingruber does not participate in dispute resolution proceedings of a consumer arbitration board and is not obliged to do so.



10. Changes in services/rebookings


10.1. Big 5 Africa Tours - Ulrike Steingruber undertakes to inform the customer immediately of any changes to or deviations in services in accordance with § 651f II of the German Civil Code (BGB). In the event of a subsequent, significant change to an essential travel service, the customer is entitled to withdraw from the travel contract or to request participation in an equivalent trip, provided the tour operator can offer such a trip from its portfolio without additional cost. If applicable, the customer will be offered a free rebooking.


10.2. Any warranty claims remain unaffected insofar as the modified services are defective.


10.3. The customer has no right to changes regarding the travel date, destination, departure point, or accommodation after conclusion of the contract, provided that Big 5 Africa Tours - Ulrike Steingruber has fulfilled its pre-contractual information obligations pursuant to Article 250 §§ 1-3 of the Introductory Act to the German Civil Code (EGBGB). If, at the customer's request, changes are to be made to the travel date, departure point, accommodation, mode of transport, or airline after conclusion of the contract and up to 30 days before departure, Big 5 Africa Tours will charge the customer the actual costs incurred per person. A processing fee of €25 is also agreed upon.


10.4. Customer requests for changes to their booking made from the 29th day before departure onwards can only be processed, if at all possible, by canceling the original booking and making a new one. This does not apply to changes that incur only minor costs.


10.5. Requests to change the travel destination are generally only possible by cancelling the original booking. Travel contract cancellation and subsequent new booking possible.



11. Risk and illness during the tour


11.1. The customer accepts that all trips and travel components booked with Big 5 Africa Tours - Ulrike Steingruber have a certain adventurous character and involve a certain degree of personal risk. Neither the company nor its service providers or partners can be held liable for injuries of any kind, the death of the traveler, or damage to property, regardless of the cause. The customer therefore agrees to refrain from making any claims against the company in the aforementioned cases. The customer assumes full responsibility for all potential risks arising from this type of trip. We request written confirmation of this waiver of liability before participating in any additionally booked activities.


11.2. Big 5 Africa Tours - Ulrike Steingruber is committed to conducting the safari according to the agreed route and at the agreed price. If a client becomes ill or unwell and the tour cannot be conducted, or can only be partially conducted, no refunds will be issued.



12. During the journey


12.1. Authority during travel

The guide's decisions are authoritative and final. For their own safety, clients must adhere to these decisions, as well as to the regulations, rules, and laws of the countries visited. Requests for minor program changes that do not significantly disrupt the overall trip can be discussed with the guide and will be accommodated whenever possible.


12.2. Force Majeure

Big 5 Africa Tours - Ulrike Steingruber is not liable for events attributable to force majeure. These include, for example, war, technical and mechanical breakdowns, bad weather, civil unrest, and unforeseen events beyond the company's control that lead to delays or changes in the itinerary.


12.3. Booking error

Should individual services (rental vehicle/hotels) arranged by Big 5 Africa Tours - Ulrike Steingruber not be available due to booking errors or force majeure, Big 5 Africa Tours undertakes to arrange alternative services promptly.



13. Severability Clause

Should any provision of this agreement be invalid, the validity of the remaining provisions shall not be affected. The statutory regulations shall apply in place of any invalid provision.
